Program Terms and Conditions

About the Program

The Reliance Foundation Jr. NBA Program (the "Program") is a comprehensive youth basketball initiative that applies the values of basketball to positively impact the lives of Indian boys and girls. The Program is designed to inspire kids to come to school, promote a healthy active lifestyle, and inculcate the positive values in participating youth by integrating basketball into each participating school’s physical education curriculum. The Program is a unique, comprehensive program in partnership with participating schools in India, which include government municipal schools and private international schools.

The Program, which remains free for all participants, includes a trainer initiative for local basketball coaches ("Jr. NBA Coaches Academy") and in-school basketball clinics for kids that culminates in city finals featuring 3-on-3 and 5-on-5 competitions between the participating schools (such competitions, "City Finals Competitions"). NBA staff will be based in each city in which the Program is organized or held (each, a "Program City") to oversee the Program. Each participating school will receive essential equipment to encourage and facilitate participation among its students, including an India-specific coaching guide with curricula for in-school and after-school programs, basketballs, cones, and a Reliance Foundation Jr. NBA poster.

About the Site

The rf.jrnba.com online and mobile websites, applications and/or services (each, a "Site" and collectively the Sites) provide coaches and students the opportunity to engage further with the Program via the Coaches Gratification Program (defined below) and the Students Gratification Program (defined below) on the Sites (each, a "Contest" and collectively the "Contests") and, subject to these Program Terms and Conditions, offers registered users of the Sites (each, a "User") the opportunity to win the prizes set forth herein.

By participating in the Program and Contests and by submitting photos onto the Sites, you hereby agree that you have read, understood, agreed and complied with the following Program rules and terms and conditions ("Program Terms and Conditions"). You agree to comply with and be bound by the Program Terms and Conditions, as mentioned below.

Contest Entry

Contests for coaches are open only to coaches who are basketball coaches or physical education teachers of registered Jr. NBA partner schools (each, a “School”) and who are legal residents and are physically located in India (each, a “Coach”). Contests for students are open to all who are between class 1 and class 10 in India and who are legal residents and are physically located in India (each, a “Student”). No payment and/or purchase are necessary to participate in the Program.

Employees, consultants, directors, representatives and officers of the National Basketball Association (“NBA”), NBA Properties, Inc., NBA India Basketball Private Limited (“NBAI”), NBA Media Ventures, LLC, the NBA member teams, and each of their respective affiliates (collectively, the “NBA Entities”), Concept Communications Limited and the Reliance Foundation, Program sponsors and platform sponsors and their family members, distribution agencies, web design agencies, advertising agencies, fulfillment agencies, involved in the administration, development, fulfillment and execution of this Program and the immediate family members (spouse, recognized partner, parent, child, sibling and spouse or “step” of each) and those living in the same households of each individual are ineligible to participate in the Contests and win prizes.

If you are a Coach, you may register for the Contests by clicking on the “Coaches” section on the top menu bar. If you are a Student, your parent or legal guardian may register you for the Contests by clicking on the “Sign In” tab on the top menu bar. Although registration by a Coach or a Student may be completed using his/her Facebook or Google Plus account, all information provided pursuant to the registration process is provided to NBAI and the operator of the Sites, Concept Communications Limited. All Coaches and Students registering for the Program and any Contest who uses his/her Facebook or Google Plus account must adhere to the Facebook or Google Plus terms and conditions, as the case may be. Duplicate registrations of the same person may result in the disqualification of the User. NBAI reserves the right to verify the information provided by the User and/or ask proof of the same.

Coaches Gratification Program

Eligibility
Coaches must register on the Site in accordance with these Program Terms and Conditions to be eligible to participate in, and accrue points and win prizes for, the Program-related activities and contests described in this section (the “Coaches Gratification Program”).

Once registered, Coaches shall accrue points based on their participation in the four activities set out below. Accrual of points shall commence and terminate for each Program City (and the Coaches resident in such Program City) depending on the start and end dates of the Program activities for such Program City as determined by NBAI in its discretion.

The Four Ways Coaches Earn Points

1. Daily Reports: For each Jr. NBA training session a Coach conducts in a School in accordance with the terms of such School’s commitment letter with NBAI or its agents (each such training session, which shall be no less than 30-45 minutes in duration, a “Training Session”), the Coach will accrue ten (10) points by sending, only on the day such Training Session was conducted, a text-based or verbal report (each, a “Daily Report”) to the following Program contacts: text-based Daily Reports shall be sent via SMS or Whatsapp messages to +91-9248006202 (the “Jr. NBA Mobile Contact”) and verbal Daily Reports may be made by speaking with NBAI’s agent, SV EduSports Private Limited, which will contact Coaches. Each Daily Report shall contain the number of Training Sessions conducted by the Coach on such day and the total number of students that participated in those Training Sessions.

2. Training Session Photos: For each Training Session a Coach conducts, the Coach will accrue ten (10) points by sending a digital photograph (each, a “Training Session Photo”) to the Jr. NBA Mobile Contact via Whatsapp. While there is no limit on the number of Training Session Photos a Coach may submit per Training Session, only ten (10) points will be awarded for each Training Session, regardless of the number of Training Session Photos submitted.

3. Student Registrations on the Sites: When a Student’s parent/legal guardian registers him/her on the Sites, they will have an option to select the Student’s School from a drop down menu. This dropdown menu will list the Schools enrolled in the Program. (The list will contain an ‘other’ option for Students not attending a School (i.e., a school enrolled in the Program.) Once the School is selected, a dropdown menu will list the names of Coaches from that School and the Student will be able to select only one (1) Coach from that School as such Student’s referral to the Program. For each Coach who is selected as a referral as part of a Student’s registration on the Sites, such Coach will accrue five (5) points. Coaches will accrue twenty (20) bonus points for every 10th Student for which such Coach is selected as a referral.

4. Student Participation at City Finals Competitions: Subject to these Program Terms and Conditions, for each Student that participates in a City Finals Competition from a Coach’s School, such Coach will accrue one (1) point; provided that each Coach agrees that no Students from such Coach’s School will participate in a City Finals Competition without the express written consent of (a) each such Student’s parent or legal guardian and (b) the applicable School.

Each Coach can track his/her point totals on his/her dashboard on the “Coaches” section of the Site, when he/she is logged in. The Coach can see the following :
- His/her city rank
- His/her national rank

The Coaches with the highest current point totals at the city and national levels will be featured on the applicable leaderboard (the “Coaches Leaderboards”) located on the homepage of the Site. The Coaches Leaderboards will be updated every 48 hours on an ongoing basis during the Program term and display the top 5 city-level Coaches and the top 10 national-level Coaches.

Gratification

Weekly Prizes. Subject to these Program Terms and Conditions, at the end of each Week (defined below) during the term of the Program, the top 5 coaches on the Coaches Leaderboard for each Program City will be eligible to receive prizes as follows: the Coach with the highest point total as of the end of the Week will receive a smartphone; the Coach with the second highest point total as of the end of the Week will receive sports shoes; and the three Coaches with the third, fourth and fifth highest point totals as of the end of the Week will receive NBA-branded t-shirts. All prizes provided hereunder shall be selected by NBAI in its sole and absolute discretion. “Week” means the period designated a “week” by NBAI for the applicable Contest, commencing and concluding at such times as determined by NBAI in its sole discretion.

Program End Prizes. Subject to these Program Terms and Conditions, at the end of the Program term, the top 5 Coaches on the Coaches Leaderboard for each Program City will be eligible to receive prizes as follows: The Coach with the highest point total as of the end of the Program term (as determined by NBAI in its sole discretion) will receive an LED TV; the Coach with the second highest point total as of the end of the Program term will receive a Samsung tablet; the Coach with the third highest point total as of the end of the Program term will receive a smartphone; the Coach with fourth highest point total as of the end of the Program term will receive running shoes; the Coach with the fifth highest point total as of the end of the Program term will receive an NBA-branded t-shirt.

Subject to these Program Terms and Conditions, at the end of the Program term, the top 5 Coaches on the Coaches Leaderboard for each Program City will each be eligible to receive such additional awards or recognition to be determined by NBAI in its sole discretion.

Ties. In the event of a tie (i.e., two or more Coaches have the same total points as of the applicable period) for any prize (i.e. weekly prize or year-end prize) at any prize level (i.e., first place, second place and so forth), then NBAI shall conduct a tiebreaker based on the percentage of each applicable Coach’s School population that is registered for the Program on the Sites (or such other tiebreaking mechanism as determined by NBAI in its sole and absolute discretion) (the “Coaches Tiebreaker”), with the Coach from the School with the highest Program registration percentage (or such other mechanism as determined by NBAI in its sole and absolute discretion) winning such Coaches Tiebreaker. The second-place Coach resulting from such Coaches Tiebreaker shall be deemed the winner of the next prize level, if any. Other Coaches with the third, fourth and fifth-place results from the Coaches Tiebreaker shall be deemed winners of the prize level, if any, corresponding to each Coach’s Coaches Tiebreaker result. The determination of any Coaches Tiebreaker results and award of prizes to Coaches pursuant to a Coaches Tiebreaker shall be made in the sole and absolute discretion of NBAI and shall be final.

Jr. NBA Coaches Academy Certification. All Coaches attending an on-ground Jr. NBA Coaches Academy clinic must complete and pass the online test conducted via the Sites in order to receive his/her certificate of completion for the Jr. NBA Coaches Academy.

Students Gratification Program

Eligibility
A Student must be registered by his/her parent/legal guardian on the Site in accordance with these Program Terms and Conditions to be eligible to participate in, and accrue points and win prizes for, the Program-related activities and contests described in this section (the “Students Gratification Program”) and have the opportunity to win prizes.

Once registered, Students shall accrue points based on their participation in the games and activities on the Site as set out below.



The Ways Students Earn Points
1. Playing Games :
a. “Through the Hoops” Game: At the “Beginner” level, the Student will be able to play the “Through the Hoops” game and earn 100 points per basket scored.
b. “Shoot ‘Em Up” Game: At the “Amateur” level, the Student will be able to play the “Shoot ‘Em Up” game and earn 100 points per basket scored.
c. “Like a Pro!” Game: At the “Pro” level, the Student will be able to play the “Like a Pro!” game and earn 300 points per basket scored if the ball does not bounce off the hoop or backboard; 200 points per basket scored if the ball bounces off the hoop or backboard once; and 100 points per basket scored if the ball bounces off the hoop or backboard more than once.

2. Completing Quizzes: At any level, the Student will be able to earn 100 points per quiz question correctly answered for the first time.
3. Watching Videos: At any level, the Student will be able to earn 100 points for each video he/she views (in its entirety) on the Site for the first time. Subsequent views of the same video will not be awarded points.
4. Downloading Program Curriculum: At any level, the Student will be able to earn 250 points for each lesson of a Program curriculum he/she downloads from the Site for the first time. Subsequent downloads of such lesson from a Program curriculum will not be awarded points.
5. Creating Customized Posters: At any level, the Student will be able to earn 500 points for each customized poster he/she creates.
6. Sharing on Social Media: At any level, the Student will be able to earn, in addition to any points earned for completing the activities in 1 to 5 above, three times (3X) the number of points earned with respect to a completed activity by sharing such completed activity on his/her Facebook, Twitter or Instagram account. For example, if a Student creates a customized poster (earning 500 points) and shares such poster on his/her Facebook account, the Student will earn an additional 1500 points.

Beginner/Amateur/Pro Levels of Competition

Each Student shall earn 500 points once his/her registration on the Site is completed by his/her parent or legal guardian. Each Student will start at the “Beginner” level and compete for prizes on the Site against other Students at the “Beginner” level. If a Student accrues 10,000 points in accordance with these Program Terms and Conditions, then the Student shall advance to the “Amateur” level and compete for prizes on the Site against other Students at the “Amateur” level.

If a Student accrues 25,000 points in accordance with these Program Terms and Conditions, then the Student shall advance to the “Pro” level and compete for prizes on the Site against other Students at the “Pro” level.

Students with the highest current point totals at each of the “Beginner”, “Amateur” and “Pro” levels will be featured on the applicable “Beginner”, “Amateur” and “Pro” leaderboard (the “Student Leaderboards”) located on the homepage of the Site. A Student will only be able to see the Student Leaderboard corresponding to his/her current level (e.g., “Beginner” level Students can only see the “Beginner” Student Leaderboard). The Student Leaderboards will be updated every 48 hours on an ongoing basis during the Program term and display the top ten (10) Students for each level.

Gratification

Weekly Prizes. Subject to these Program Terms and Conditions, at the end of each Week during the term of the Program, the top three Students on each of the Student Leaderboards will be eligible to receive prizes (each, a “Weekly Prize”) as follows: (i) at the “Beginner” level, the three (3) Students with the highest point total as of the end of the Week will receive a merchandise voucher (or other prize as determined by NBAI in its sole discretion) (“Voucher”) valued at INR 1,000; (ii) at the “Amateur” level, the three (3) Students with the highest point total as of the end of the Week will receive a Voucher valued at INR 2,500; and (iii) at the “Pro” level, the three (3) Students with the highest point total as of the end of the Week will receive a Voucher valued at INR 4,000. A Student will only be eligible to win a Weekly Prize once for each of the “Beginner”, “Amateur” and “Pro” levels.

Monthly Prizes. Subject to these Program Terms and Conditions, at the end of each Month during the term of the Program, the top four (4) Students on each of the Student Leaderboards will be eligible to receive prizes (each, a “Monthly Prize”) as follows: (i) at the “Beginner” level, the four (4) Students with the highest point total as of the end of the Month will receive a Voucher valued at INR 5,000 and a Scholarship valued at INR 10,000; (2) at the “Amateur” level, the four (4) Students with the highest point total as of the end of the Month will receive a Voucher valued at INR 6,000 and a Scholarship valued at INR 20,000; and (3) at the “Pro” level, the four (4) Students with the highest point total as of the end of the Month will receive a Voucher valued at INR 8,000 and a Scholarship valued at INR 30,000. A Student will only be eligible to win a Monthly Prize once for each of the “Beginner”, “Amateur” and “Pro” levels. “Scholarship” means one of the following: (x) payment towards a Student’s school tuition fee (if any); (y) a voucher for basketball instruction at an NBA-branded basketball academy; or (z) payment towards a Student’s “health and wellness” expenditures. In each case, the determination of which Scholarship to provide a prize winner and the method of delivering such Scholarship (e.g., paying the Student’s school directly) shall be made by NBAI in its sole and absolute discretion. In no event will a Scholarship be provided in the form of cash. “Month” means the period designated a “month” by NBAI for the applicable Contest, commencing and concluding at such times as determined by NBAI in its sole discretion.

Program End Prize. Subject to these Program Terms and Conditions, at the end of the Program term, the top Student on the Student Leaderboard for the “Pro” level will be eligible to receive a Scholarship valued at INR 50,000 (the “Grand Prize”).

Winners of the Weekly Prizes, Monthly Prizes and Grand Prize will be notified via his/her registered email address and upon log-in to their account on the Site of their prize and details on collection of prizes. Notices to prize winners that do not receive a reply from the Student’s registered email address within ten (10) days shall be disqualified from eligibility for such prize and such Student shall be deemed to have forfeited his/her prize. NBAI shall in its discretion reallocate any forfeited prizes to the Student with the next highest points total for such level.

Ties. In the event of a tie (i.e., two or more Students have the same total points as of the applicable period) for any prize (i.e. Weekly Prize, Monthly Prize or Grand Prize) at any prize level (i.e., first place, second place and so forth), then NBAI shall conduct a tiebreaker based on the time each applicable Student took to reach his/her points total (or such other tiebreaking mechanism as determined by NBAI in its sole and absolute discretion) (the “Students Tiebreaker”), with the Student reaching his/her points total the earliest winning such Students Tiebreaker. The second-place Student resulting from such Students Tiebreaker shall be deemed the winner of the next prize level, if any. Other Students with the third, fourth and fifth-place results from the Students Tiebreaker shall be deemed winners of the prize level, if any, corresponding to each Student’s Students Tiebreaker result. The determination of any Students Tiebreaker results and award of prizes to Students pursuant to a Students Tiebreaker shall be made in the sole and absolute discretion of NBAI and shall be final.

Additional Terms

(A) Each Contest prize winners will be subject to the final approval of NBAI and determination by NBAI (in its sole and absolute discretion) that such prize winner’s participation in the Contests was conducted in compliance with the Program Terms and Conditions. The participation of any person in the Program or any Contest may be terminated, without prior notice, at any time and for any reason by NBAI in its sole and absolute discretion. NBAI’s decision in each case is final and no correspondence will be entertained.

(B) In the event of a dispute, any person’s entitlement to participate in the Program, any Contest and/or receive any prize is subject to the sole discretion and final determination of NBAI.

(C) Each participant (whether a Coach, Student or otherwise) in the Program and/or in any Contest (“Participant”) may be required to submit a release and waiver form, executed by Participant or Participant’s parent or legal guardian (if Participant is a minor), as a condition to receiving certain prizes (as determined by NBAI).

(D) Participants (and the parent/legal guardian of a Participant on such Participant’s behalf) hereby makes the following representations :
(i) Participant will abide by all rules, procedures and conditions for participation in the Program and/or Contest, which will be determined by NBAI in its sole discretion;
(ii) The information of the Participant (and his/her parent/legal guardian) provided for registration is accurate and valid. Participant shall be disqualified from the Program and/or Contest if Participant has provided inaccurate, false or invalid information or inconsistent with or in violation of the Program Terms and Conditions.
(iii) Participant is in good physical condition and able to participate in the Program and the Contests;
(iv) Participant does not violate any laws or regulations or the rights of any third party by participating in the Program and/or any Contest;
(v) Participant (and his/her parent/legal guardian) fully appreciates the potential risks of the Program and Contests, including the risks of bodily injury. Participant is willing (and Participant’s parent/legal guardian (if Participant is a minor) is willing to permit Participant) to participate in the Program and expressly and knowingly accepts all potential risk of injury;
(vi) Participant (and his/her parent/legal guardian if Participant is a minor) hereby assumes all risks and consequences arising from participating in the Program and any Contest. Participant (and his/her parent/legal guardian if Participant is a minor) agrees not to hold the NBA Entities liable for any losses, damages or expenses Participant suffer from the Program or any Contest;
(vii) the content submitted and/or uploaded by the Participant is original and is not a copy, adaptation or translation or remake or dubbed version of any other literary, artistic, musical, dramatic, or cinematographic work or photograph of any third party;
(viii) the content to be submitted and/or uploaded by the Participant does not infringe or misappropriate any third party rights including any intellectual property rights or moral rights and that the Participant is legally authorized to upload/ exhibit this work.

(E) Except as may be required under applicable law, the NBA Entities make no warranties, implied or otherwise, about any prize offered as part of the Program or any Contest, including warranties as to the quality, guarantee, merchantability or fitness for purpose of such prize, its value, enjoyment, condition, quality or fitness for any purpose. The prizes are awarded on ‘as is’ basis and the NBA Entities shall not be held liable in any manner whatsoever for any of the above.

(F) Prizes cannot be transferred, assigned, redeemed for cash, substituted, modified or altered, except as may be approved by NBAI in its sole discretion, due to prize unavailability, and in such event a prize may be substituted for one of comparable or similar value, as determined by NBAI in its sole discretion. Particular prizes may be subject to change. Participants and winners (and his/her parent/legal guardian if Participant is a minor) are solely responsible for all applicable taxes and all other expenses not specified herein.

(G) Each Participant’s participation in the Program and/or any Contest, and eligibility for any prize, is subject to such Participant (or his/her parent/legal guardian if Participant is a minor) agreeing to and accepting the Privacy Policy and Terms of Use of the Sites.

(H) Participants (and, if Participant is a minor, his/her parent/legal guardian, on behalf of such Participant) agree to be bound by these Program Terms and Conditions and agree that: (a) the NBA Entities may use (except to the extent prohibited by law) Participant’s name, voice, city/state/country of residence, school, photographs, video or film clips, and/or other visual likeness for advertising and/or trade purposes and/or for any other purpose in any media or format now or hereafter known, throughout the world in perpetuity, without further compensation (financial or otherwise), permission or notification. The Participant hereby grants to NBA Entities an exclusive, irrevocable, perpetual, worldwide and royalty free right in the content submitted by the Participant. The Participant agrees and undertakes to, at any and all times, upon request, to make, execute and deliver without charge, any and all such other instruments as maybe necessary or desirable for the purpose of giving full force and effect to the Program Terms and Conditions and the provisions thereunder; (b) the Participant authorizes NBA Entities to retain a copy of the content submitted by the Participant in their archives/library, and/or the right to showcase it in public screenings or broadcasts as NBA Entities may in their sole discretion deem appropriate, without any payment, royalty or consideration. The Participant further agrees that the right to withhold an award in any category or to create any special award for a program that they feel deserves special recognition will be shall be made in the sole and absolute discretion of NBAI; (c) the NBA Entities may reproduce, modify, rearrange, alter, adapt the content as provided by the Participant to make it fit for use, in any format/form/media/medium now known or discovered in future, in any manner whatsoever without need for notice, compensation, consideration or approval; and (d) the NBA Entities, Reliance Foundation and each of their respective parent companies, subsidiaries, affiliates, officers, directors, employees, governors, owners, distributors, retailers, agents, assignees, advertising/promotion agencies, representatives, agents, designees and assigns shall have no liability and will be released and held harmless by such Participant (and, if Participant is a minor, his/her parent/legal guardian, on behalf of such Participant) from any claim, action, liability, loss, injury or damage, including, without limitation (but subject to operation of law), personal injury or death to Participant or any third party or damage to personal or real property due in whole or in part, directly or indirectly, by any reason, including the acceptance, possession, use or misuse of a prize and/or participation in the Program or any Contest.

(I) Photo / video uploads to the Sites by any Participant shall not contain nudity, profanity, racism or violence in any form. Any content submitted and/or uploaded by the Participant is not defamatory, obscene, seditious, contravenes or constitutes a breach of privacy, publicity, incites hatred, racist, against India or in any other respect in contravention of the applicable laws in India.

(J) The use of third party content, if any, as identified at the time of submitting the content by the Participant has been made with the prior written permission/consent/license of such third party. The Participant agrees and undertakes to disclose use of all third party content, if any, along with the identity, exact content which is being used, duration, purpose and manner of use of such third party content and the permissions obtained from such third party, at the time of submitting and/or uploading any content.

(K) The content submitted by the Participant has not been previously published or publicly shown or entered in any other competition or program or won a prize or award.

(L) Any failure to display credit line for any of the content used by NBA Entities shall not be deemed to be a breach of the Program terms and Conditions by NBA Entities, partners or sponsors.

(M) The NBA Entities are not responsible for any untimely or incomplete registration to the Program or any Contest, or for technical problems in connection with the transmission or receipt of electronic information, including faulty electronic data transmission, traffic congestion on the Internet or on the Sites, hardware or software error, equipment failure or malfunction, human errors of any kind, or other online communications problems or any combination thereof. No liability or responsibility is assumed by the NBA Entities resulting from a User’s attempt to participate in the Program or any Contest or download any information from the Sites in connection with participating in the Program or any Contest.

(N) If for any reason the Program or any Contest is not capable of running as planned, or is postponed or cancelled or is prevented from taking place, including due to infection by computer (or similar) virus, bugs, tampering, unauthorised intervention, actions by entrants or any third party, fraud, technical failures or any other causes beyond NBAI or Concept One’s control, which corrupt or affect the administration, security, fairness or integrity or proper conduct of the Program or any Contest, NBAI reserves the right in its sole discretion (i) to disqualify any individual who tampers with the registration, game play, points accrual or other process, or any individual implicated in such action, (ii) to take any action that may be available, and (iii) to cancel, terminate, modify or suspend the Program or applicable Contest, subject to any written direction given under applicable laws or regulations.

(O) It is a condition of accepting any prize that the winner must comply with all the conditions of use of the prize imposed by NBAI or any third party or prize supplier. NBAI is entitled to verify the validity of any registration of any Participant and his/her identity. NBAI reserves the right in its sole discretion to disqualify any individual who NBAI has reason to believe has breached any of these conditions (or any other term of these Program Terms and Conditions), or engaged in any unlawful or other improper misconduct calculated to jeopardize the fair and proper conduct of the Program or any Contest. The NBA Entities’ legal rights to recover damages or other compensation from such an offender are reserved.

(P) Participants and prize winners (and his/her parent/legal guardian if Participant is a minor) are responsible for all transportation and any related travelling expenses incurred by them (including but not limited to meals, drinks, transfers, laundry charges, activities, incidentals, taxes (including airport taxes, departure taxes), energy surcharges, gratuities, services charges, travel insurance and all other ancillary costs) in connection with participating in the Program or any Contest, including attending any City Finals Competition or in connection with collecting any prize.

(Q) The NBA Entities make no representation as to the safety, conditions or other circumstances that may exist at any destination at which a Program clinic or other activity (including but not limited to the City Finals Competition) is conducted.

(R) Prize winners will be notified by e-mail promptly upon determination and verification by NBAI of such recipient’s eligibility. Each scholarship recipient’s parent/legal guardian shall sign and return an Affidavit of Eligibility and Liability/Publicity Release (“Release Documents”) within one (1) day of notification by NBAI. If NBAI is unable to contact a scholarship recipient within one (1) day of the first attempted notification or if such recipient fails to return the Release Documents within the specified time period or if written notification is returned as undeliverable, such recipient’s right to claim the scholarship will be forfeited.

(S) In the case of the intervention of any outside act, agent or event which prevents or significantly hinders the NBAI’s ability to proceed with the Program or any Contest on the dates and in the manner described in these Program Terms and Conditions, including but not limited to vandalism, power failures, tempests, natural disasters, acts of God, civil unrest, strike, war, act of terrorism, NBAI may in its absolute discretion cancel the Program and/or any Contest and, in its absolute discretion, determine when, if at all, to recommence the Program and/or Contest from the start on what conditions, subject to any requirements of applicable law.

(T) NBAI reserves the rights to unilaterally alter, modify, revise, change or withdraw these Program Terms and Conditions, and any aspect of the Program (including but not limited to its structure, scope, content, rules, judging method and prizes) at its sole discretion, at any time and without notice. Participation in the Program and/or any Contest shall constitute acceptance of these Program Terms and Conditions and any amendments thereof.

(T) By entering into this Program and/or Contests, the Participant agrees that it does not construe or amount to a contract or an offer for employment from/with the NBA Entities, Reliance Foundation, partners and/or sponsors. Neither party owes a fiduciary duty to the other. Nothing herein shall be in any way construed to constitute the Participant to be an agent, employee or representative of NBA Entities.

Governing Law and Jurisdiction

All disputes arising under this competition shall be governed by the laws of India and the courts at Mumbai shall have exclusive jurisdiction to adjudicate all disputes.
